Terms of Service

These Terms of Service ("Terms") govern your use of Sticked, including the mobile application, website, and related services (collectively, the "Service").
The Service is operated by Denis Volyntsev ("Sticked", "we", "us", or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You may use the Service only if:
- you are at least 13 years old, or the minimum age required in your country to use online services like ours;
- you have the legal capacity to agree to these Terms; and
- if you are under the age of majority in your jurisdiction, you have permission from a parent or legal guardian.
2. The Service
Sticked allows users to create, manage, export, and optionally publish sticker packs and related content. The Service includes:
- sticker creation and editing tools (image and video);
- export to third-party messaging platforms (including Telegram and WhatsApp);
- a public Marketplace for browsing and adding user-created sticker packs;
- push notifications for shared pack activity, Marketplace updates, and other Service events;
- advertising in the free version of the Service; and
- an optional paid subscription that removes ads.
We may add, change, suspend, or remove features from time to time.
3. Accounts
You may need to connect a Telegram account or create an account to use some features of the Service. You are responsible for maintaining the security of your account and for all activity that occurs under it.
You must provide accurate information and keep it reasonably up to date.
4. Subscription and Ads
4.1 Free version
The Service displays advertisements to users of the free version. Ads are served through Unity LevelPlay (ironSource), which may use its own tracking and targeting technologies. See Section 3 of the Privacy Policy for details.
4.2 Subscription
We offer an optional paid subscription that removes ads from the Service while your subscription is active.
4.3 Billing
If you purchase a subscription through the Apple App Store, Google Play, or another third-party app store, your purchase is processed by that platform and is subject to its terms and billing rules.
4.4 Renewal and cancellation
Unless otherwise stated by the platform through which you purchased, subscriptions renew automatically until cancelled. You can manage or cancel your subscription through the account settings of the platform you used to purchase it.
4.5 Refunds
Refunds, if any, are handled according to the rules of the platform through which you purchased the subscription.
5. Your License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
You may not:
- copy, distribute, sell, lease, or sublicense the Service except as expressly permitted;
- reverse engineer, decompile, or attempt to extract source code, except where applicable law prohibits us from restricting this;
- interfere with the operation or security of the Service;
- use automated means (bots, scrapers, spiders, or similar) to access, scrape, or extract data from the Service except as permitted by us in writing;
- collect email addresses or other personal information from other users through the Service;
- impersonate another person or entity;
- use the Service for unlawful, abusive, or fraudulent purposes; or
- assist or encourage any third party in engaging in any activity prohibited by these Terms.
6. Your Content
6.1 Ownership
You retain ownership of the images, videos, text, stickers, pack metadata, and other material you upload, submit, or create through the Service ("Content").
6.2 License to us
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify as technically necessary, display, and distribute your Content solely to:
- operate and provide the Service;
- enable sticker creation, storage, syncing, and export;
- display and distribute Content that you choose to publish in the Marketplace;
- secure, review, moderate, debug, improve, and support the Service; and
- promote the Service using published Marketplace content.

We will not sell your Content to third parties outside the scope of the Service.
6.3 Duration
This license continues for as long as your Content remains in the Service, except that we may retain limited copies for backup, security, legal compliance, dispute resolution, and enforcement purposes.
7. Marketplace
The Service includes a public Marketplace where users can publish sticker packs for other users to browse, search, and add to their collections.
7.1 Publishing
If you publish a sticker pack to the Marketplace, you represent and warrant that:
- you own the Content or have all rights necessary to publish it;
- publishing and use of the Content through the Service does not infringe any third-party rights; and
- the Content complies with these Terms and applicable law.
7.2 Moderation
All submissions to the Marketplace are subject to review and moderation by us. We reserve the right, in our sole discretion, to approve, decline, remove, or ban any submission for any reason, including but not limited to violations of these Terms or our content guidelines.
Submission statuses (Under Review, Published, Declined, Banned) are provided for your information. A declined submission may be revised and resubmitted. A banned submission may not be resubmitted. You may cancel a pending submission at any time before it is approved.
When we take a moderation action (such as declining, removing, or banning content), we will inform the uploader of the decision and the reasons for it. Where a report from another user led to the action, we may also inform the reporting user of the outcome.
We may also suspend or restrict accounts that repeatedly violate these Terms.
7.3 License to other users
When another user adds your published sticker pack through the Service, that user receives a limited, personal, non-commercial license to use that sticker pack within messaging platforms and features supported by the Service. Users may not resell, redistribute outside the Service, or claim ownership of sticker packs created by other users.
7.4 Reporting content
If you believe Marketplace content is illegal or infringes your rights, you may report it by contacting justdevelopers@gmail.com and including enough information for us to review the report (such as the sticker pack in question, the nature of the issue, and your contact details).
7.5 Appeals
If your Marketplace content is removed or restricted, you may contact justdevelopers@gmail.com to request a review of the decision.
7.6 Availability
We do not guarantee that any Marketplace content will remain available. Sticker packs may be removed at any time due to moderation decisions, account termination, or at the request of the original creator.
8. Prohibited Content and Conduct
You may not use the Service to create, upload, publish, export, or distribute Content that:
- is illegal, fraudulent, deceptive, or promotes unlawful activity;
- infringes copyright, trademark, privacy, publicity, or other rights;
- contains malware, harmful code, or spam;
- is defamatory or harassing;
- contains sexual exploitation material, child sexual abuse material, or content involving minors in a sexualized way;
- contains threats, incitement to violence, or extremist material; or
- impersonates another person or entity in a misleading or harmful way.
You also may not:
- interfere with another user's ability to use or enjoy the Service;
- attempt to gain unauthorized access to systems or accounts; or
- circumvent moderation or enforcement measures.
9. Third-Party Services and Platforms
The Service integrates with and allows export to third-party services and platforms, including Telegram and WhatsApp. Your use of these integrations is also subject to the respective terms and privacy policies of those platforms.
When you export Content to a third-party platform:
- that Content leaves our servers and becomes subject to that platform's terms and privacy practices;
- we do not control how that platform stores, processes, distributes, or removes the Content;
- you are responsible for ensuring that your exported Content complies with that platform's rules.
We are not liable for any loss, modification, or misuse of Content once it has been exported to a third-party platform.
10. Intellectual Property
The Service, including its software, design, branding, features, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are granted to you.
11. Feedback
If you send us feedback, suggestions, or ideas about the Service ("Submissions"), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use them without restriction or compensation to you. We have no obligation to keep any Submissions confidential. This section does not apply to your Content that you use in connection with the Service.
12. Representations and Warranties
You represent and warrant that:
- you have the full power and authority to enter into and perform under these Terms;
- your use of the Service will not infringe on the copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other legal right of any third party;
- you will comply with all applicable laws, rules, and regulations;
- there are no claims, demands, or any form of litigation pending or, to the best of your knowledge, threatened with respect to any of your Content; and
- your Content does not contain viruses or any other programs or technology designed to disrupt or damage any software or hardware.
13. Disclaimers
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all warranties and conditions, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and correspondence to description.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that Content will always be available, preserved, or successfully exported.
14. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability to you for claims arising out of or relating to the Service will not exceed:
- the amount you paid to us for the Service during the 12 months before the event giving rise to the claim; or
- EUR 50, if you did not pay us anything.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
15. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Denis Volyntsev, and any employees, representatives, agents, affiliates, directors, officers, managers, and shareholders (the "Parties") from any damages, loss, or expense (including without limitation, attorney's fees and costs) incurred in connection with any third-party claim, demand, or action arising from:
- your Content;
- your misuse of the Service; or
- your breach of these Terms.
If you have to indemnify us under this section, we will have the right to control the defense, settlement, and resolution of any claim at your sole expense. You may not settle or otherwise resolve any claim without our express written permission.
16. Termination
We may suspend or terminate your access to the Service, remove Content, or restrict Marketplace activity if:
- you breach these Terms;
- we are required to do so by law; or
- your use of the Service creates risk for us, other users, or third parties.
If you or we terminate your use of the Service, we may delete any Content or other materials relating to your use of the Service on our servers or otherwise in our possession, including any Content published to the Marketplace. To the fullest extent permitted by law, we will have no liability to you or any third party for doing so.
You may stop using the Service at any time.
17. Changes to the Service or Terms
We may modify the Service or these Terms from time to time.
If we make material changes to these Terms, we will provide reasonable notice, for example by updating the date above, posting a notice in the Service, or using another appropriate method.
Your continued use of the Service after the changes take effect means you accept the updated Terms.
18. Governing Law
These Terms are governed by the laws of the Netherlands, excluding its conflict of laws rules.
If you are a consumer residing in the European Union, you also benefit from any mandatory protections provided by the laws of your country of residence.
The invalidity or unenforceability of any provision of these Terms will not affect the validity or enforceability of any other provision, all of which will remain in full force and effect.
19. Miscellaneous
These Terms will be binding upon each party and its successors and permitted assigns. These Terms will not be assignable or transferable by you without our prior written consent. These Terms contain the entire understanding of the parties regarding this subject matter, and supersede all prior and contemporaneous agreements. No failure or delay by a party in exercising any right, power, or privilege under these Terms will operate as a waiver thereof. You and we are independent contractors, and no agency, partnership, joint venture, or employee-employer relationship is intended or created by these Terms.

This Privacy Policy describes how we collect, use, and protect your information when you use Sticked, including the mobile application, website, and related services (collectively, the "Service"). We respect your right to privacy and feel it is important for you to know how we handle the information we receive from you.

2.1 Information you provide
When registering on our Service, as appropriate, you may be asked to enter your name, email address, or Telegram account information. You may use certain features of the Service anonymously.
2.2 Information we collect automatically
When you use the Service, we automatically collect:
- Device information: device type, operating system, unique device identifiers
- Usage data: app interactions, feature usage, sticker creation and sharing activity
- Analytics data: we use Firebase Analytics to collect aggregated usage statistics, including session data, screen views, and user engagement metrics
- Push notification tokens: if you enable push notifications, we collect your device token to deliver notifications about shared pack activity, Marketplace moderation decisions, and other Service updates
- Crash and performance data: diagnostic information to help us identify and fix technical issues
- Advertising data: our ad provider, Unity LevelPlay (ironSource), may collect device identifiers, IP address, and usage data to serve and measure advertisements in the free version of the Service
3. Third-Party Services
We use the following third-party services to operate the Service:
- Firebase (Google): authentication, database, analytics, cloud messaging, and hosting
- Telegram Bot API: for Telegram sticker pack integration and bot-based features
- WhatsApp: for sticker pack export functionality
- Google Cloud Platform: server infrastructure and data processing
- Unity LevelPlay (ironSource): ad mediation and delivery in the free version of the Service
These third-party services may collect and process data according to their own privacy policies. We encourage you to review:
4. Legal Bases for Processing
Where applicable under the General Data Protection Regulation (GDPR) or similar laws, we process your personal data on the following legal bases:
- Performance of a contract: to provide and operate the Service, including account management, sticker creation, export, and Marketplace features;
- Legitimate interests: to secure, maintain, moderate, and improve the Service, to prevent fraud and abuse, and to understand how users interact with the Service;
- Consent: where required by law, such as for push notifications and certain advertising or analytics tracking — you can withdraw consent at any time through your device or app settings;
- Legal obligation: to comply with applicable laws, regulations, or legal processes.
5. How We Use Your Information
We use the information we collect to:
- Provide and operate the Service, including sticker creation, storage, syncing, and export
- Operate and moderate the Marketplace, including reviewing submitted sticker packs
- Personalize your experience and respond to your individual needs
- Improve the Service based on the information and feedback we receive
- Send push notifications about activity in your shared sticker packs, Marketplace moderation decisions, and other Service-related updates — you can manage your notification preferences within the app settings or disable notifications through your device settings at any time
- Display advertisements in the free version of the Service through Unity LevelPlay (ironSource)
- Send periodic emails — the email address you provide will only be used to send you information and updates related to the Service
- Improve customer service and respond to support requests
6. International Transfers
Some of our third-party service providers (including Google and Unity) may process personal data outside the European Economic Area (EEA). Where required by applicable law, we rely on appropriate safeguards for such transfers, such as the European Commission's Standard Contractual Clauses or the service provider's participation in recognized data protection frameworks.
7. How We Protect Your Information
We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our Service, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.
We may also release your information when we believe release is appropriate to comply with the law, enforce our policies, or protect ours or others' rights, property, or safety.
8. Data Retention
We retain your personal information for as long as your account is active or as needed to provide you the Service. If you delete your account, we will delete or anonymize your personal information within a reasonable timeframe, except where we are required to retain it by law.
Content you have published to the Marketplace may persist after account deletion if it has been added to other users' collections, though it will no longer be attributed to your account.
9. Your Data Rights
Depending on your jurisdiction, you may have the right to:
- Access the personal data we hold about you
- Correct inaccurate personal data
- Delete your personal data
- Export your personal data in a portable format
- Object to or restrict certain processing of your data
- Withdraw consent at any time, where processing is based on consent
- Lodge a complaint with your local data protection supervisory authority

10. Your Consent
By using our Service, you consent to this Privacy Policy. Where specific processing activities require separate consent (such as push notifications or personalized advertising), we will ask for your consent at the appropriate time.
